By commissioning me, or owning a design / concept I created, you agree to these following terms.If you have any questions or concerns, feel free to contact me on any of my socials or via email.

✦ I reserve the right to decline commissions, cancel and refund money at any time for any reason.
✦ I retain full rights over my artworks. this includes but is not limited to the right to use artworks as a sample for sales / self-promotion, or add artworks to personal galleries, portfolios, and/or social medias.
✦ I reserve the right to modify any rejected artworks to be kept or sold at a later date.
✦ Commissioned artworks are strictly for NON commercial use. Commercial work is subject to additional terms and a contract in place.
✦ By breaking my TOS, you forfeit all rights to the commissioned work. I will retain the right to reuse and resell the work, and you may be blacklisted from interacting with my business again. Should you own a design by me on Toyhouse, I may report you to staff for breaking my TOS.
✦ Respond clearly and within a timely manner when asked for feedback.
✦ Assume responsibility for failing to provide the required information at the appropriate time during the project.
✦ ALWAYS credit the artworks to FALSEHERETIC when posting the commissioned artwork online. (please do not credit other variations of my username, such as "falseheretiic")
✦ Pay for additional transactions and currency conversions included in the payment.
✦ Communication is to be conducted via Artistree. Alternatively Discord if you prefer not to use Artistree for communication.
✦ Clients may be sent work in progress images during the project for feedback or revisions, depending on the type of commission.
✦ Artworks are not guaranteed to be finished on a specified deadline. However, I will try my best to meet any reasonable time frame you have in mind. Rushed deadlines may require an extra fee.
✦ Completed commissions will be sent in PNG format. You may request HD files be sent via email (you must provide your email). I do not distribute PSD files.
✦ Payment is upfront. Payment must be complete in full prior to beginning the project.
✦ Payments are made in USD via Artistree (Artistree uses Stripe for payment)
✦ I do not take DeviantArt Points or any other form of virtual currency as payment unless otherwise specified.
✦ Major edits or revisions to artworks or requests for rushed deadlines may require an extra fee.
✦ Completed artworks cannot be refunded.
✦ Artworks are only refundable if it is incomplete. A kill fee of 30% of the total value will be charged for the termination of a project.
✦ If I, for some reason, am unable to finish the project within 6 months, you may opt for a full refund.
✦ If you request a chargeback at any point during or after the project, you will lose all aforementioned rights to the artwork and I will retain the right to reuse and resell the artwork, and you will be blacklisted from interacting with my business again.
✦ custom designs MUST be uploaded to Toyhouse. Toyhouse registration codes can be provided, should you not have an account. This is for safety purposes, so the design can be tracked.
✦ You must always credit FALSEHERETIC for created artworks and designs. Failure to credit is a violation of the TOS. (please do not credit other variations of my username, such as "falseheretiic")
✦ You have the right to use your commission for any personal use you want (avatars / icons / profile pictures, wallpapers, banners, personal galleries, etc.) with proper credit given.
✦ You may not profit off the commissioned art or use it in a commercial manner, it is for personal use only.
✦ You may not use the commissioned art or design for any form of hate speech or bigotry.
✦ Do not manipulate / edit the commissioned artwork in any way without direct permission from me.
✦ Do not remove the watermark or signature on the artwork.
✦ You may not use any of the artworks for any sort of NFT / blockchain / cryptocurrency.
✦ You may not feed any of the artworks into AI programs.

By owning a design / concept I created, you agree to these following terms.
these terms can also be viewed in the "ownership" toyhouse tab on all characters created by me.If you have any questions or concerns, feel free to contact me on any of my socials or via email.

✦ I retain full rights to all my designs.
this includes but is not limited to the right to use all designs as a sample for sales / self-promotion, or add designs to personal galleries, portfolios, and/or social medias.✦ once a character transfer has been complete, they are non refundable.
rarely i may buy back a character,
but please assume that once a transaction is complete, it cannot be undone.
USAGE
✦ Under no circumstances are you allowed to replicate or claim the design as being created by you or someone else other than myself.
Even in the case of redesigns, please credit me as the original designer.
Always credit the design to FALSEHERETIC.

If you refuse to credit me i may reclaim the design and resell it.✦ Once you legitimately own one of my designs, you may use it in whatever fashion you like!
You may use it as a sona, mascot, kin, vent/rant character, or as a character in stories/worlds/projects. All as long as they are not for commercial use, and not used for any sort of hate speech or bigotry.
I don't care if you make NSFW of my designs, as long as you follow Toyhouse's NSFW rules.✦ You may resell or trade my designs in whatever way (and for however much) you please.
But please take into consideration how much you originally paid for the character, and how much worth it may have gained in that time. If you did not pay for additional art please do not sell the character for unrealistic prices. (such as $100+ over the original price)✦ You may create alternate designs/species/genders/AU's/etc of the original design.
But please do not separate additional designs from the original design. When selling or trading the character, please keep additional designs with the original.
OWNERSHIP
✦ The character MUST stay on Toyhouse.
If sold to someone who does not have Toyhouse, I can offer the new owner a code, you can keep the profile on your account, or you can transfer it back to me and i will store it on my storage account.
This helps me keep track of my designs.
Designs deleted off Toyhouse will be assumed as voided, and without proof of ownership I will treat as stolen.✦ You may co-own my designs, but it is not my responsibility to settle any ownership disputes.✦ I will not get involved in any ownership disputes unless it violates my TOS.✦ Once ownership has been exchanged, you no longer have any rights to the character.
You may no longer dictate how the character is used, or use it yourself without the permission of the new owner.✦ Blocked users are automatically blacklisted,
and may not receive any of my designs.

i am mentally ill. aside from audhd, i have memory issues and chronic fatigue, i am often very tired, and sometimes unwell. please be patient with me.
i block frequently to curate my spaces. you may reach out if you think i've made a mistake. but i do not owe a reply or reason.
i prefer not engage with discourse. those who harass, abuse, and/or engage with callout culture will be blocked.

my stance on callouts

like if someone's doing some weird shit and hiding it i think people would want to be warned about that at least.

"The existence of a callout posts means that the targeted person will be harassed if enough people see it.There is no amount of “don’t harass anyone mentioned in this doc/video” disclaimers that will prevent that. The post is now potentially a permanent record that anyone can cite for years into the future.You are now at the whims of unknown strangers to be banned from communities, kicked out of creative projects, or be blocked by friends, at any time with no warning.I would consider this to be harassment, but to people who don’t know about how these things usually go down they would be seen as righteous whistle blowers.-No matter what you actually did, if your awkward interaction with someone was too sexual, or if you stated a shitty opinion about a complex topic, or if you misjudged someone’s boundaries, or if you engaged with kink in a way that made someone outside the scene uncomfortable, you are now a predator.I have seen firsthand the game of telephone starting from “this person did/said something sexualized on an online platform where teenagers could have been present,” to “acted creepy around teenagers,” to “regularly sexually assaulted children,” to “pedophile”.-Callout posts do not actually stop the person from “doing weird shit”.It depends on what you mean by “weird shit”, but if you mean “secretly draws / engages with Bad Porn”, which is what a lot of callout posts are about, I implore you to recognize that it is truly not your business to know every private action someone takes just because you follow them on social media.This applies to awkward interactions people have in private too. Sometimes it’s patterns of abuse, but a lot of the time it’s interpersonal drama that is not anyone else’s business.-If by “weird shit” you mean that someone has demonstrated ongoing patterns of real emotional / financial / sexual / etc abuse, and it’s something that cannot be handled by any other means (either privately or with legal action if relevant), then in those cases a callout post can potentially do more good than harm if it reaches the people that need to know about it.-The level of long-term mental anguish that a target can go through is absolutely no fucking joke.A callout post has the potential to be a gun to someone’s head, especially if they’re socially / mentally / physically disadvantaged to begin with, which conveniently describes the most likely people to be targeted with high profile callout posts.This is because:1.) Our communities are wayy more likely to self-police than the rest of the internet and2.) there are groups such as kiwifarms that love when a trans girl does something they can suicide bait her with and they also love it when we infight, isolate, and attack each other.-I don’t think callout posts are inherently evil, but they do nothing to make the target not continue their unwanted behaviour.The only good function a callout post can serve is to warn potential future victims.If there are no victims, no behaviour that will DIRECTLY lead to someone being victimized, no scam being uncovered, no patterns of abuse being shared, then the only victim is the target of the callout post.Everyone else involved is just gawking at gossip and/or contributing to suicidal levels of anxiety to a stranger."
