i conduct my commissions from artistree!
the payment method for artistree is credit/debit card, cash app, apple pay, or google pay. all via stripe.
if you cannot use these payment methods, i may also take paypal commissions through direct dm.

Terms of Service
Please read carefully.
By commissioning me, FALSEHERETIC ("The Artist"), you ("The Client") affirm you have read and agree to be legally bound by the following terms. Failure to abide by these terms may result in commission rejection / cancellation, design revocation, and/or blacklisting.
These terms are subject to change at any time without notice.If you have any questions or concerns, feel free to contact me on any of my socials or via email.

General
✦ The Artist reserves the right to decline or cancel commissions at any time, with or without explanation.✦ The Client reserves the right to cancel the commission at any time, for whatever reason.✦ The Artist retains full rights over artworks. this includes but is not limited to the right to use artworks as a sample for sales / self-promotion, add artworks to personal galleries, portfolios, and/or social medias.✦ The Artist does not claim ownership to any of the characters / subjects portrayed in the commission. Characters belong to their respective creator(s).✦ The Artist reserves the right to modify any rejected artworks to be kept or sold at a later date.✦ The Artist does not work on a "first come first serve" basis. Simpler commissions may be worked on in between larger commissions.✦ Commissions may only be ordered by a Client 18 years of age or older. If the Artist has any reason to suspect the Client is underage, the commission will be automatically rejected / cancelled.✦ By breaking the Terms of Service, the Client forfeits all rights to the commissioned work. The Artist retains the right to reuse and resell the work, and the Client may be blacklisted from interacting with the business again.
Client Obligations
✦ The Client is expected to respond clearly and within a timely manner when asked for feedback.✦ The Client is expected to assume responsibility for failing to provide the required information at the appropriate time during the project.✦ The Client may contact the Artist at any time to ask for a progress check on the commission, but no more than once a week.✦ The Client must ALWAYS credit the artworks to FALSEHERETIC when posting the commissioned artwork online. Do not credit other variations of the username, such as "falseheretiic".✦ The Client is expected to pay for additional transactions and currency conversions included in the payment.
Process
✦ Communication for the commission is to be conducted via Artistree. Alternatively Discord if the Client prefers not to use Artistree.✦ All commissions will be done digitally. There will be no hard copies. The Client is paying for a service / digital good and will not require any shipping of any kind.✦ Clients may be sent work in progress images during the project for feedback or revisions, depending on the type of commission.✦ Artworks are not guaranteed to be finished on a specified deadline. However, the Artist will attempt to meet any reasonable time frame the Client has in mind. Rushed deadlines may require an extra fee.✦ Completed commissions will be sent in PNG format. The Client may request HD files be sent via email (The Client must provide their email). The Artist does not distribute PSD files.✦ Unless specified not to upload the commission to the public, all commissions will be posted on the Artist's social media.
Requesting the commission to be private will require a fee.
The Client may request to remain anonymous when the Artist publicly uploads the commission.✦ Commissions will only be posted publicly after the Client has received and approved the commission.
Payment
✦ Payment is upfront. Payment must be complete in full prior to beginning the project.✦ Payments are made in USD via Artistree.
In the case of not using Artistree, payment is to be completed via PayPal invoice. in this case, the Artist will require the Client's PayPal email.✦ The Artist does not take DeviantArt Points or any other form of virtual currency as payment unless otherwise specified.✦ Major edits or revisions to artworks or requests for rushed deadlines may require an extra fee.✦ Payment must be sent within 72 hours after confirmation.
Refunds
✦ Completed artworks cannot be refunded.✦ Artworks are only refundable if it is incomplete. A kill fee of 30% of the total value will be charged for the termination of a project.✦ If the Artist is for some reason unable to finish the project within 6 months, the Client may opt for a full refund.✦ If the Client attempts to perform a chargeback at any point during or after the project, they henceforth forfeit all rights to the artwork and will be blacklisted. the Artist will retain the right to reuse and resell the work.✦ The Client will not be refunded if they are unsatisfied with the commission.
If the Client is unsatisfied with the commission, the Artist is willing to discuss and make minor edits. Any major revisions will require a fee. The only major revisions permitted without fee are details that the Artist may have missed and was specified by the Client in the order form / revision process.
Usage
✦ Commissioned artworks are strictly for NON commercial use. Commercial work is subject to additional terms and a contract in place.✦ Custom designs MUST be uploaded to Toyhouse. Toyhouse registration codes can be provided, should the Client not have an account. This is for safety purposes, so design ownership can be tracked.✦ The Client must ALWAYS credit the artworks to FALSEHERETIC when posting the commissioned artwork online. Failure to credit is a violation of the TOS. do not credit other variations of the username, such as "falseheretiic"✦ The Client has the right to use their commission for any personal use (icons, profile pictures, wallpapers, banners, personal galleries, etc.) with proper credit given.✦ The Client may not profit off the commissioned art or use it in a commercial manner, it is for personal use only.✦ Do not manipulate / edit the commissioned artwork in any way without direct permission from the Artist.✦ Do not remove the watermark or signature on the artwork.✦ Artworks may not be used for any form of hate speech or bigotry.✦ Artworks may NOT be used for NFTs, cryptocurrencies, and/or blockchains.✦ Feeding artwork into any variation of generative AI is prohibited.

General
✦ I retain full rights to all my designs.
This includes but is not limited to the right to use all designs as a sample for sales / self-promotion, or add designs to personal galleries, portfolios, and/or social medias.✦ Once a character transfer has been complete, they are non refundable.
rarely i may buy back a character,
but please assume that once a transaction is complete, it cannot be undone.
Usage
✦ Under no circumstances are you allowed to replicate or claim the design as being created by you or someone else other than myself.
Even in the case of redesigns, please credit me as the original designer.
Always credit the design to FALSEHERETIC. Do not credit other variations of my username, such as "falseheretiic"
If you refuse to credit me i may reclaim the design.✦ Once you legitimately own one of my designs, you may use it in whatever fashion you like!
You may use it as a sona, mascot, kin, vent/rant character, or as a character in stories/worlds/projects. All as long as they are not for commercial use, and not used for any sort of hate speech or bigotry.
I don't care if you make NSFW of my designs, as long as you follow Toyhouse's NSFW rules.✦ You may resell or trade my designs in whatever way (and for however much) you please.
But please take into consideration how much you originally paid for the character, and how much worth it may have gained in that time. If you did not pay for additional art please do not sell the character for unrealistic prices. (such as $100+ over the original price)✦ You may create alternate designs / species / genders / AU's / etc of the original design.
But please do not separate additional designs from the original design. When selling or trading the character, please keep additional designs with the original.
OWNERSHIP
✦ The character MUST stay on Toyhouse.
If sold to someone who does not have Toyhouse, I can offer the new owner a code, you can keep the profile on your account, or you can transfer it back to me and i will store it on my storage account.
This helps me keep track of my designs.
Designs deleted off Toyhouse will be assumed as voided, and without proof of ownership I will treat as stolen.✦ You may co-own my designs, but it is not my responsibility to settle any ownership disputes.✦ I will not get involved in any ownership disputes unless it violates my TOS / TOU.✦ Once ownership has been exchanged, you no longer have any rights to the character.
You may no longer dictate how the character is used, or use it yourself without the permission of the new owner.✦ Blocked users are automatically blacklisted,
and may not receive / acquire any of my designs.
